1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and 01go.ai ("01go," "we," or "us") governing your access to and use of our website at 01go.ai, our AI chat, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Description of Services

01go provides AI-forward innovation consulting, including brand strategy, go-to-market strategy, creative development, and technology enablement. The AI chat and website are for informational and lead-generation purposes only. No client relationship, consulting engagement, or binding obligation is created until we expressly agree in a separate written agreement.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Services. By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Electronic Consent and Communications

When you submit information through our chat, forms, or other means, you consent electronically under the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and similar laws. You agree that we may store and use your information as described in our Privacy Policy. We may communicate with you by email or other electronic means; you consent to receive such communications.

5. Accuracy of Information

You represent and warrant that all information you provide (including name, email, company, and role) is accurate, current, and complete. You are responsible for maintaining the accuracy of such information. We are not liable for any loss or damage arising from inaccurate or misleading information you provide.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems, networks, or data
  • Abuse, overload, or interfere with our AI chat or infrastructure
  • Scrape, harvest, or collect data from the Services without our written consent
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Services to send spam or unsolicited communications

We reserve the right to suspend or terminate your access for any violation of these Terms.

7. Intellectual Property

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, design, and software) are owned by 01go or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our content without our prior written consent. You may view and use the Services for your personal, non-commercial use in accordance with these Terms.

8. AI-Generated Content

Our AI chat uses third-party AI models. AI-generated responses are for informational purposes only and do not constitute professional advice. We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You rely on such content at your own risk. For formal consulting engagements, we provide human-delivered services under separate agreements.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 01GO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless 01go and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content or information you submit through the Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts. You waive any right to a jury trial and any right to participate in a class action.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and 01go regarding the Services and supersede any prior agreements, understandings, or communications.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.
